These Terms and Conditions (“Terms”) govern your access to and use of the website located at http://propertyphotographygta.com/ (the “Site”), operated by Property Photography GTA. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Site.
You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Site. Unauthorized use or modification of any information stored on this Site may result in criminal and/or civil prosecution.
All content on the Site, including but not limited to images, videos, text, logos, graphics, and software, is the property of Property Photography GTA or its content suppliers and is protected by applicable copyright, trademark, and other intellectual property laws. You may not use, reproduce, or distribute any content without prior written permission.
When you hire Property Photography GTA, you purchase a license to use the content we create for your marketing purposes. You do not own the content and may not share, gift, resell, sublicense, or transfer it to others. You may not recover your expenses through the resale or redistribution of the content.

Property Photography GTA provides real estate photography, videography, aerial footage, and related digital content services. All services are subject to availability and acceptance by Property Photography GTA.
Pricing is outlined in the applicable service descriptions, booking details, invoices, or proposals. Payments are due as specified on the invoice or at the time of booking, as applicable. Payments are non-refundable except as required by applicable law or otherwise agreed in writing.
5.1 Revisions – For photo and video projects, Property Photography GTA provides one (1) complimentary revision after the initial delivery. Additional revisions requested by the client may incur extra charges, which will be quoted and agreed upon before further work begins.
5.2 Refunds – Due to the subjective nature of creative work, Property Photography GTA does not offer refunds solely because a client dislikes the creative style, design choices, or artistic direction after a project has been delivered. Reasonable efforts will be made during the included revision process to address client feedback. This policy does not limit any rights or remedies available under applicable law.
Photos: Delivered within 24 hours of the scheduled session, except for Friday sessions, which are delivered on Monday.
Videos: Delivered within 48 hours of the scheduled session, except for Friday sessions, which are delivered on Monday unless otherwise specified in the project scope.
Delivery timelines may vary where the project scope, property conditions, technical issues, or other circumstances require additional time. Any material changes to the agreed timeline will be communicated to the client where reasonably possible.
Property Photography GTA, its team members, videographers, photographers, and administrative staff are not responsible for the loss, theft, or damage of personal belongings, valuables, or property during on-site work, except where liability cannot be excluded under applicable law.
The real estate agent, homeowner, or authorized representative is responsible for securing valuables and personal belongings before the session and providing safe access to the property.
If you submit materials such as testimonials, comments, or images, you grant Property Photography GTA a non-exclusive, royalty-free license to use, reproduce, and distribute those materials in connection with our services, marketing, and service improvement, subject to applicable law and any permissions or restrictions agreed upon.
You are responsible for the content you submit and confirm that you have the necessary rights or permissions to provide it.
The Site may contain links to websites operated by third parties. Property Photography GTA has no control over these sites and is not responsible for their content, availability, or privacy practices. Visiting linked sites is at your own risk, and we encourage you to review their applicable terms and privacy policies.
The Site and its information, content, and materials are provided on an “as is” and “as available” basis, to the extent permitted by applicable law.
Property Photography GTA makes no warranties, express or implied, regarding the Site, including warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such warranties cannot lawfully be excluded.
To the fullest extent permitted by applicable law, Property Photography GTA shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits or revenues arising from your use of the Site or our services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
To the extent permitted by applicable law, you agree to indemnify and hold harmless Property Photography GTA, its employees, contractors, and agents from claims, liabilities, damages, losses, and expenses arising from your violation of these Terms, your unlawful use of the Site, or your infringement of another party’s rights.
We reserve the right to suspend or terminate your access to the Site or our services where reasonably necessary, including if you violate these Terms or misuse the Site, subject to applicable law and any existing contractual obligations.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.
Property Photography GTA SMS Program
By opting in to our SMS messaging program, you agree to receive text messages from Property Photography GTA relating to services, appointment reminders, updates, customer support, and promotional messages where you have provided the required consent.
Message frequency may vary depending on your interaction with us and your selected messaging preferences.
You can cancel the SMS service at any time by replying STOP to a message from us. We will send a confirmation message to acknowledge your unsubscribe request. Following confirmation, you will no longer receive SMS messages from us unless you opt in again.

Carriers are not liable for delayed or undelivered messages.
Message and data rates may apply to messages sent to you from us and to us from you. Message frequency varies. For questions about your text or data plan, contact your wireless provider.
